What Are Terms and Conditions?
Terms and conditions, agreement terms, and business terms all refer to the same thing.
Your terms and conditions should clearly outline the terms that apply when your customers make a purchase.
According to the Danish E-commerce Act, the Consumer Agreement Act, and the Sale of Goods Act, the terms and conditions must be clearly and visibly stated. These laws set out requirements for the terms that apply to a transaction, both before, during, and after the purchase. This also applies if you wish to run an online store.
This is also one of the reasons why your customers must actively accept your terms and conditions before checkout.
The Importance of Having Terms and Conditions
Terms and conditions are just as important for your own protection. As a webshop owner, you are bound by the laws mentioned above.
That’s why your customers have the same rights, regardless of whether you inform them about them or not.
Without terms and conditions on your website, any disputes will be settled according to the applicable laws, ensuring decisions are made with the consumer's best interests in mind.
If a disagreement arises between you and a customer, the rules are designed to favor the customer, unless you have your terms and conditions clearly stated on your webshop.
It gives you the chance to clearly outline your expectations when a deal is made. Adding terms and conditions to your site helps safeguard your interests as a webshop owner.
With updated terms and conditions, you can ensure a smooth process when your customers wish to return a product or make a warranty claim.

Key Elements to Include in Your Terms and Conditions
These 10 points represent the standard information your customers expect from you.
Make sure to adjust each point to your business, providing the most relevant information for your customers.
1. About the Company: Informing your customers about your business helps create a sense of security. Include key details such as your company name, address, and CVR number.
2. Prices and Payment: Make the calculations easy for your customers. Describe how the prices are structured, how payment is processed, and the available payment methods.
3. Delivery: Let your customers know when they can expect to receive their goods. Also, inform them about the delivery method and the available options, including how the shipping cost is calculated and whether free shipping is offered for orders over a certain amount.
4. Responsibility: In this section, explain your business's responsibility when customers purchase products or services from you. This may vary depending on the type of product and whether the purchase is for private or business use. Don’t forget to include information about their right to claim a warranty.
5. Returns: Ensure that your customers know the condition the items must be in when returned, how they should be returned, and the time frame they have to do so. Don’t forget to specify whether the customer or your business is responsible for the return shipping costs.
6. Data Protection: Tell your customers how their data is handled and used by your business. Compliance with data protection laws is essential, and your customers will want to be sure you're adhering to these regulations.
7. Complaint Procedures: When selling to private consumers, you are obligated to provide information on EU complaint options. Make sure you have this covered and can offer the necessary details.
8. Contact: Let your customers know the best way to reach you and your business if they have comments, complaints, or questions.
9. Updates: Explain how your business might make changes to the terms and conditions, how customers will be informed, and what these updates will mean for them.
10. Legal Terms and Jurisdiction: Provide information on which legal system applies to the transaction. If your company is based in Denmark, Danish laws will apply. Make sure to separate the terms for standard purchases and subscriptions if you offer both.
As you can tell, there are some key points you should include in your terms and conditions. The more attention you give to them from the beginning, the better protected you'll be, and the smoother your transactions will go.
3 Tips for Creating Terms and Conditions
Keep them brief:
It is a legal requirement to have terms and conditions on your webshop. Fortunately, there are no specific rules regarding the length or number of points. That’s why we recommend making them as concise and clear as possible. Only include the terms that apply to your webshop.
Make them easy to navigate:
Once you've selected the terms that apply to your webshop, take the time to set them up correctly. Make sure to prioritize the most important ones (for the customer) and place them at the top. Additionally, use headings so your customers can easily navigate and find the information they consider most relevant.
